What Is a Multiple DWI?

Simply put, a multiple DWI is a DWI that is a repeat offense. In Texas, a multiple DWI is a second, third, or subsequent DWI conviction.

Multiple DWI charges can be based on previous DWI convictions that occurred at any time. In other words, if you have a prior DWI conviction from 20 years ago, that conviction will be considered when determining the appropriate penalties for your current DWI charge.

It is also important to note that you can be charged with a multiple DWI even if you were not previously convicted of DWI. For example, if you were previously arrested for DWI but the charges were dismissed, you can still be charged with a multiple DWI. Likewise, if you were arrested for and convicted of underage DWI and are later arrested for and convicted of adult DWI, you can be charged with a multiple DWI.

Consequences of Multiple DWIs in Texas

When you are convicted of a second, third, or subsequent DWI in Texas, you face a range of enhanced penalties. These penalties are outlined in the Texas Penal Code and can be quite severe, even for a third-offense DWI.

Penalties for a third-offense DWI in Texas include:

  • Between 2 and 10 years in state prison
  • Up to $10,000 in fines
  • Driver's license suspension for up to 2 years
  • Annual surcharges of $2,000 to $2,500 for 3 years to maintain your driving privileges
  • Required installation of an ignition interlock device (IID) in all of your vehicles

As you can see, the penalties for a multiple DWI conviction are extremely serious. In addition to the above penalties, you will also have a permanent criminal record, which can make it difficult to secure employment, find housing, or obtain professional licenses. You will also face significantly higher auto insurance premiums and may face other collateral consequences.
